These Terms of Service (“Terms”) apply to the use of the website www.catlangdonpilates.com and the purchase or booking of Pilates classes, sessions, programmes and other services provided by CAT LANGDON PILATES (“I”, “me”, “my”, “we” or “us”).
By booking or purchasing a service, you agree to these Terms.
Please read them carefully before making a booking.
1. About my services
I provide Pilates instruction and related fitness and wellbeing services, including:

one-to-one Pilates sessions;

group Pilates classes;
-
online Pilates sessions;
-
courses or programmes;
-
workshops;
-
memberships or class packages; and
-
other services described on my website.
The specific services available, their prices and their duration will be stated on the website or at the time of booking.
I reserve the right to make reasonable changes to the services offered, including class times, locations, instructors and programme content.
2. Health and suitability
Pilates involves physical activity and exercise.
Before participating, you are responsible for informing me of any health condition, injury, pregnancy, medication, physical limitation or other circumstance that may affect your ability to exercise safely.
I may ask you to complete a health and fitness questionnaire or provide other relevant information before participating.
You should provide information that is accurate and complete and inform me of any relevant changes to your health.
If you have any concerns about whether Pilates or a particular exercise is suitable for you, you should seek appropriate advice from your doctor, physiotherapist or another suitably qualified healthcare professional before participating.
I may decline, modify or stop a session if I reasonably believe that continuing would be inappropriate or unsafe.
3. Medical advice
My Pilates services are intended to provide exercise instruction and are not medical treatment or medical advice.
I am not acting as your doctor, physiotherapist or other healthcare professional unless expressly stated otherwise.
Any information provided during a Pilates session should not be treated as a diagnosis or substitute for professional medical advice.
You should seek appropriate medical advice where necessary.
4. Your responsibility during sessions
You are responsible for:

following reasonable instructions given during a session;
-
informing me if an exercise causes pain, discomfort, dizziness, breathlessness or other concerning symptoms;
-
stopping an exercise if you feel unable to perform it safely;
-
informing me of any relevant change in your health;
-
using equipment appropriately;
-
behaving reasonably and respectfully towards me and other clients; and
-
arriving prepared and appropriately dressed for the session.
If you experience significant or unusual symptoms during exercise, you should stop exercising and seek appropriate medical assistance.
5. Bookings
Bookings can be made through:

A booking is confirmed when:

you have completed the booking process; and
-
where applicable, payment has been successfully received.
You must provide accurate information when making a booking.
Bookings are generally personal to you and may not be transferred to another person without my prior agreement.
6. Prices and payment
Prices for my services are displayed on my website or provided to you before booking.
All prices are stated in pounds sterling (£) unless otherwise indicated.
Payment may be made using the payment methods made available at the time of booking.
[PAYMENT PROVIDER, e.g. Bank, Stripe / PayPal / SumUp] may process payments on my behalf.
I reserve the right to change my prices in the future. Any price change will not affect a booking that you have already paid for unless otherwise agreed.
Where VAT applies, prices will be stated accordingly.
7. Cancellation by you
I understand that circumstances can change. However, cancellations and late changes can make it difficult to offer the appointment to another client.
My cancellation policy is:
All purchases are final. Cat Langdon Pilates does not offer refunds on services due to change of mind, injury, illness or change of address.
No late entry is permitted, so please ensure you arrive to the studio at least 5 minutes before class starts, otherwise the instructor may refuse entry. This is for your own safety and to limit class disruption.
Cat Langdon Pilates reserves the right to cancel and change teachers and or class without prior notice.
If you cancel within 48hours you may be able to reschedule for a later date.
If you fail to attend a booked session without cancelling (“no-show”), the session may be treated as used and/or the full booking fee may be charged.
Where exceptional circumstances apply, I may use my discretion to waive or reduce a cancellation charge.
8. Your statutory cancellation rights
If you book services online or otherwise at a distance, you may have statutory cancellation rights under applicable UK consumer law.
In some circumstances, however, the statutory cancellation period may not apply in the usual way to a service scheduled to take place on a specific date or during a specific period.
If you request that a service begins during a statutory cancellation period, additional rules may apply.
Nothing in these Terms is intended to remove or restrict any consumer rights that cannot legally be excluded.
9. Late arrival
If you arrive late to a session, the session will normally still finish at the originally scheduled time.
This is to avoid unnecessarily delaying subsequent clients.
If you arrive sufficiently late that it is no longer practical or safe to provide the session, I may treat the booking as a late cancellation or no-show.
10. Cancellation or rescheduling by me
Occasionally, I may need to cancel or reschedule a session due to circumstances such as:
-
illness;
-
injury;
-
an emergency;
-
venue or equipment problems;
-
severe weather;
-
technical problems affecting an online session; or
-
circumstances outside my reasonable control.
Where I cancel a session, I will normally offer you an alternative date or time or, where appropriate, a refund or credit.
I will try to provide reasonable notice whenever possible.
11. Class and session changes
I may reasonably modify exercises, class content, instructors, locations or session arrangements where necessary.
For example, I may modify an exercise to accommodate a client's needs or because a particular exercise or piece of equipment is unavailable.
Where a significant change materially affects a service you have already purchased, I will take reasonable steps to provide an appropriate alternative or remedy.
12. Packages, memberships and credits
If I offer class packages, memberships or prepaid credits, the specific terms will be provided at the time of purchase.
Unless otherwise stated:

packages are personal to the purchaser;
-
packages cannot be exchanged for cash;
-
unused sessions may expire after the period stated at purchase;
-
missed sessions may count as used in accordance with the cancellation policy; and
-
packages cannot normally be transferred to another person without my agreement.
Any specific package or membership terms provided at the time of purchase will take precedence over this section where there is a conflict.
13. Online sessions
Where Pilates sessions are provided online, you are responsible for having:
-
a suitable internet connection;
-
an appropriate device;
-
sufficient space to exercise safely;
-
appropriate clothing;
-
any required equipment; and
-
a safe environment in which to participate.
You should position your camera where reasonably possible so that I can observe your movement and provide appropriate instruction.
I cannot guarantee that an online session will be uninterrupted or free from technical problems.
14. Physical studio and equipment
Where sessions take place at a physical studio or other venue, you must follow reasonable safety instructions and any venue rules.
You must use equipment only as instructed.
If you notice damaged or unsafe equipment, you should notify me immediately and stop using it.
15. Children and young people
Unless expressly stated otherwise, my services are intended for adults.
Where I offer services to anyone under 18, I may require appropriate consent from a parent or legal guardian and may apply additional terms.
16. Personal belongings
You are responsible for your own personal belongings when attending sessions.
I cannot accept responsibility for loss or damage to personal property except where liability cannot lawfully be excluded or limited.
17. Liability
I take reasonable care in providing my services and aim to provide Pilates instruction in a professional and appropriate manner.
However, physical exercise carries inherent risks, including the possibility of injury.
You are responsible for following instructions and informing me of relevant health conditions or limitations.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits liability for:

death or personal injury caused by negligence;

fraud or fraudulent misrepresentation; or
-
any other liability that cannot legally be excluded or limited.
Subject to the above, I will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control.
Nothing in these Terms affects your statutory rights as a consumer.
18. Intellectual property
Unless otherwise stated, the content of my website and materials I provide, including:

photographs;

videos;
-
written content;
-
exercise programmes;
-
class materials;
-
logos;
-
branding;
-
graphics; and
-
other materials
belong to me or are used with permission.
You may use materials provided to you for your own personal, non-commercial use.
You must not copy, reproduce, distribute, sell, publish or commercially exploit my materials without my prior written permission.
19. Website use
You agree to use my website lawfully and responsibly.
You must not:

use the website for fraudulent or unlawful purposes;

attempt to gain unauthorised access to the website or its systems;

introduce malicious software;

interfere with the operation of the website;

copy website content for commercial purposes; or

use the website in a way that could damage my business or other users.
I do not guarantee that the website will always be available or free from errors.

I am not responsible for the availability, content or privacy practices of third-party websites or services.

I collect and process personal information in accordance with my Privacy Policy.
Because Pilates may require me to collect information about your health and physical condition, some of the information you provide may constitute special category personal data under UK data-protection law.

venue closures;

strikes;

26. Ending or refusing services
I reserve the right to refuse or discontinue providing services where reasonably necessary, including where:

a client behaves abusively, threateningly or inappropriately;

a client repeatedly fails to follow reasonable safety instructions;

continuing the service would create an unacceptable safety risk;

payment is not made when due; or
-
there is another legitimate reason why it is no longer appropriate to provide the service.
Where appropriate, I will explain the reason and provide any refund or other remedy required by law.
27. Changes to these Terms
I may update these Terms from time to time to reflect changes to my services, business practices or legal requirements.
The latest version will be published on this website.
Changes will not normally affect bookings or purchases that have already been made, unless the change is required by law or otherwise agreed with you.
28. Governing law
These Terms are governed by the laws of England and Wales, unless applicable consumer law requires otherwise.
If you are a consumer, you may also have rights to bring proceedings in the courts of the part of the UK in which you live.
Nothing in these Terms is intended to remove or restrict any rights you have under applicable consumer-protection legislation.
